Privacy Policy

Last updated 10 August 2026. This policy is written to the Protection of Personal Information Act 4 of 2013 (POPIA) and, where it applies to you, the UK and EU General Data Protection Regulation.

The short version: this website has no cookies, no analytics and no trackers, and it has no server that receives your details. An enquiry form writes an email for you to send from your own account, to one address — our inbox — so a person can reply.

1. Who is responsible for your information

The responsible party (POPIA) and data controller (GDPR) is KGN Chemicals (PTY) Ltd, a private company registered in South Africa, manufacturing liquid flavourants, emulsions and fragrances.

2. What we collect, and when

Only what you choose to send us. There is no account to create, no newsletter, and nothing is gathered in the background as you read the site. The enquiry forms — in the contact section and on the flavour category pages — assemble a message in your browser from what you type, and you send it yourself. That message contains:

  • your name;
  • your email address;
  • your contact number, if you give one;
  • your company name, if you give one;
  • the category and any product options you selected; and
  • the message you wrote.

Each form also carries one hidden field that a person never sees or fills in. It exists to catch automated spam.

Server records. Our hosting provider keeps ordinary technical records of requests to the site — IP address, browser type, the page requested and a timestamp — for security, abuse prevention and keeping the site running. These are not used to build a profile of you and are not combined with enquiry details.

We do not ask for, and would rather you did not send, any special personal information — health, religious or philosophical beliefs, race, political opinions, trade union membership, biometric data or criminal history. Nothing on this site needs it.

3. Cookies and tracking

This site sets no cookies. It runs no analytics, no advertising or remarketing pixels, no session recording and no third-party embeds. Nothing is written to your browser's local or session storage.

Fonts, video and images are all served from our own domain rather than a content network, so simply reading the site does not report your visit to anyone else. If that ever changes — for example if we add website statistics — this policy will be updated first and you will be asked before any non-essential cookie is set.

4. Why we may use your information

To read your enquiry and reply to it. That is the whole purpose. We do not sell personal information, we do not share it for anyone else's marketing, and we will not add you to a mailing list off the back of an enquiry.

The lawful grounds we rely on:

  • Your consent — POPIA s11(1)(a); GDPR art 6(1)(a). You give it by ticking the box on the enquiry form, and you can withdraw it at any time by emailing us. Withdrawing it does not affect anything done before you did.
  • Steps towards a contract — POPIA s11(1)(b); GDPR art 6(1)(b). If your enquiry is a request for a quotation or a sample, handling it is a step taken at your own request.
  • Our legitimate interests — POPIA s11(1)(f); GDPR art 6(1)(f) — in keeping the site secure and in keeping a record of business correspondence.

5. Who else handles it

The enquiry form does not send anything. It gathers what you type and writes it into an email addressed to us, which then opens in whatever you choose — Gmail, your own mail application, or your clipboard. You press send. Until you do, nothing has left your device, and the details were never transmitted to this website.

The practical consequence is that your enquiry travels through your own email provider, not ours. Whoever handles your email sees it, under their terms, in exactly the way they see any other message you send.

WhatsApp is your choice, not ours. After an enquiry is sent, the page offers a button that opens WhatsApp with your message already written out. Nothing is sent to WhatsApp unless you press it and then send the message yourself from your own account. If you do, your message is handled by WhatsApp under Meta's own privacy terms, which we do not control.

We may also disclose information where the law requires it, or where it is necessary to establish, exercise or defend a legal claim.

6. Information leaving South Africa

Our website host is based outside South Africa and serves the site from data centres abroad. POPIA s72 allows this where the recipient is bound by rules or a contract giving substantially similar protection, and we rely on our contract with that provider for it. Your enquiry itself does not travel through them — it goes from your device through your own email provider, wherever that happens to be, which is a matter between you and them.

7. How long we keep it

Enquiries are kept as ordinary business correspondence for as long as there is a reason to — while we are dealing with your request, and afterwards for the period we may need it to answer questions about a quotation or an order, or to meet a legal or tax obligation. Where an enquiry leads nowhere, we delete it once it has no further use. Technical server records are kept for a short period only.

You can ask us to delete your enquiry sooner, and we will unless the law requires us to keep it.

8. Your rights

Under POPIA, and under the GDPR where it applies to you, you may:

  • ask what personal information we hold about you, and get a copy (POPIA s23; GDPR art 15);
  • ask us to correct or complete anything inaccurate (POPIA s24; GDPR art 16);
  • ask us to delete it where we no longer have grounds to keep it (POPIA s24; GDPR art 17);
  • object to our processing it (POPIA s11(3); GDPR art 21);
  • ask us to restrict how we use it, or to provide it in a portable form (GDPR arts 18 and 20); and
  • withdraw a consent you have given, at any time.

Email info@kgnchemicals.co.za and we will respond within a reasonable time, and in any event within the period the law allows. We do not charge for this, unless a request is clearly excessive or repetitive.

If you are unhappy with how we have handled it, please tell us first so we can put it right. You may also complain to the regulator:

9. Security

The site is served only over HTTPS. Because the enquiry form composes a message rather than transmitting one, what you type is never sent to this website at all — there is no endpoint that receives it, no database that stores it, and no credential that could expose it. Access to the inbox it eventually reaches is limited to the KGN staff who need it.

No transmission over the internet is ever completely secure, so we cannot guarantee absolute security. If a compromise of personal information ever occurs, we will notify the Information Regulator and the people affected as POPIA s22 requires.

10. Children

This is a business-to-business site and is not directed at children. We do not knowingly collect personal information from anyone under 18. If you believe a child has sent us information, tell us and we will delete it.

11. Changes to this policy

If this policy changes, the revised version will be published on this page with a new date at the top. Material changes to how we use information already collected will not be applied retrospectively without a fresh basis for doing so.
